The following is a summary of the methods available for service in Sweden as well as a specific proposal for process service.

FORMAL SERVICE

Many countries are signatories to The Hague Service Convention (treaty) that governs service of process to be effected between participating nations; Sweden is one of them. Service may be made by formal service through the Central Authority which itself arranges for service by methods prescribed in that country. Documents to be served in accordance with this method must be translated into the official language of the country where the documents will be served. The time frame can range from 2 to 4 months (recently, 2 1/2 months).

Advantage: Enforceable judgment.

Disadvantage: The time frame is generally longer than the informal method.

OPTION:  We can provide an automatic update on formal Hague service for an additional, one-time fee of $300.00.  This status update will be available once a month, or as requested, for purposes of obtaining a court deadline extension.

INFORMAL SERVICE

Private process servers may serve documents in most countries, whether a signer of The Hague Service Convention, or not. Service is normally handled in a manner similar to methods used in the United States, although completion of the service usually takes longer. Customs and traditions in Sweden tend to lead to a slower pace and less rigid work habits. Service sometimes may take several months but informal service is generally faster than the formal method. Many process servers who we employ are off-duty police officers or other government officials who are able to, in certain cases, exercise their official capacity to complete the service. Since we pay the process server a bonus (at our own expense) for prompt service, the normal delays are usually reduced. Currently, the time frame for the completion of informal service is approximately 2 weeks.

Advantage: The time frame is shorter than the formal method.

Disadvantage: Judgment “may” not be enforceable in Sweden.

PUBLICATION

Service by Publication is an alternative to personal service when a defendant's address is not known.  Your court will require that you conduct a Due Diligence Search before issuing a court order allowing for service by publication.  We handle the entire process, including the due diligence search affidavit, and preparing the Application and Order for Publication.  We will provide all forms necessary for you to submit to your local court.  Once the Order is signed by the judge, we will publish the entire file for one low rate of $995.00 and provide Proof of Publication.

DEPOSITION OF U.S. CITIZENS

VOLUNTARY WITNESS:

American attorneys may take voluntary depositions in Sweden of American citizens whenever and wherever they choose if they obtain permission from the Swedish government. In order to obtain permission from the Foreign Ministry, an informal request should summarize the cause of action and indicate that an American is a party to the suit. This procedure is not available unless an American citizen is a party to the suit.

LETTERS ROGATORY:

(for Swedish citizens): If the witness is a Sweden citizen, Swedish authorities will take a deposition of a willing witness pursuant to the terms of the Hague Convention. You will need to file Letters Rogatory with the Court of jurisdiction.

INVOLUNTARY WITNESS:

If a witness must be compelled to appear and testify in Sweden, his/her deposition can only be taken by Swedish authorities. A request and the questions to be posed to the witness must be sent directly to the appropriate.

TIMEFRAME:

Depositions should be scheduled at least 4 months after the assignment is given to us to allow sufficient time for the Swedish government to complete their duties.

TRANSLATIONS

Most countries require the documents to be translated into the official language of the nation where they are to be served (in this case, Swedish). The U.S. State Department recommends translation, but it is not a requirement unless the formal method is used. It is possible, although rare, that a demurer could be filed based upon lack of understanding by the defendant as to the nature and meaning of un-translated documents. We offer translation services at rates quoted below.

DECLARATIONS: We provide formal declarations on the status of service upon request, as required by your court, at no additional charge. We subscribe to the U.S. Department of State weekly up-dates on international service of process and the Central Intelligence Agency briefings on social conditions abroad and monitor problems in nations that might affect the completion of the service. Estimated time for completion of service is subject to change depending on current conditions.

 

WARNING: Beware of companies that quote suspiciously low rates. They often come back later with an excuse for an additional charge. Our rates are firm for one address quoted. Other companies are actually brokerage firms or website developers, not process service agencies, who farm out assignments to companies that are not knowledgeable or qualified on international service of process.

    (Note: all 3 sets can be copies; original documents are not required, except for service to India – India requires one (1) original set.)

  • 3. Payment for the service fees in U.S. dollars (we will bill you for the translation costs, if translation is required).

A note about copies: Service documents sent to us for domestic assignments are subject to a $.50/page copy fee for large files (100+ pages). Copy fees are waived for international assignments.
