Depending on your needs and on the nature of the case, we will serve your legal documents either under article 5 of the Hague Service Convention, or under article 10. In any event, service will comply with US and Canadian laws and with the Hague Service Convention.

The following is a summary of the methods available for service in Canada as well as a specific proposal for process service.
SERVICE UNDER ARTICLE 5 OF HAGUE SERVICE CONVENTION
Many countries are signatories to The Hague Service Convention (treaty) that governs service of process to be effected between participating nations; Canada is one of them. Service may be made by formal service through the Central Authority which itself arranges for service by methods prescribed in the particular Province. The time frame for formal service can range from 1 to 3 months (recently 1 1/2 months).
Advantage: Enforceable judgment.
Disadvantage: The time frame is generally longer than the informal method.

SERVICE UNDER ARTICLE 10 OF HAGUE SERVICE CONVENTION
A quicker alternative is service under Article 10 of the Hague Service Convention through a process server (or bailiff in Quebec). Service is normally handled in a manner similar to methods used in the United States while ensuring the requirements of your Court are complied with and the Proof/Affidavit of Service is generated in the format required by your Court. Currently, the time frame for the completion of service under article 10 is approximately 1 week (but can increase in case of service in remote locations).
PUBLICATION
Service by Publication is an alternative to personal service when a defendant’s address is not known. Your court will require that you conduct a Due Diligence Search before issuing a court order allowing for service by publication. We handle the entire process, including the due diligence search affidavit, and preparing the Application and Order for Publication. We will provide all forms necessary for you to submit to your local court. Once the Order is signed by the judge, we will publish the entire file for one low rate of $995.00 and provide Proof of Publication.

LETTERS ROGATORY
As Canada is not a signatory to Hague Evidence Convention as opposed to the popular belief, letters rogatory are used to obtain evidence or testimony formally from parties in Canada. The process is not as cumbersome and expensive as for other countries around the world and there is no need to process a case through diplomatic channels.
Letters Rogatory are requests from a court in the United States to a court in a foreign country requesting international judicial assistance related to service of process.
TRANSLATIONS
The official language in Canada is English, except in Quebec Province where the official language is French. For cases in Quebec, the U.S. State Department recommends translation, but it is not a requirement unless the formal method is used. It is possible, although rare, that a demurer could be filed based upon lack of understanding by the defendant as to the nature and meaning of un-translated documents. We offer translation services at rates quoted below.
