The following is a summary of the methods available for service in the United Kingdom as well as a specific proposal for process service.

FORMAL SERVICE

England (UK) is a signatory to The Hague Service Convention (treaty) that governs service of process to be affected between participating nations. Service may be made by formal service through the Central Authority which itself arranges for service by methods prescribed in that country. The time frame can range from 3 to 5 months.

Advantage: Enforceable judgment.

Disadvantage: The time frame is generally longer than the informal method.

INFORMAL SERVICE

Private process servers may serve documents in most countries, whether a signer of The Hague Service Convention, or not. Service is normally handled in a manner similar to methods used in the United States. Service in England is very efficient and similar to the time frames within the United States. Our office in London coordinates all services in Great Britain and is extremely thorough and efficient. Since we pay our process servers a bonus (at our own expense) for prompt service, the normal delays are usually reduced. Currently, the time frame for the completion of informal service is approximately 1 to 2 weeks.

Advantage: The time frame is shorter than the formal method.

Disadvantage: Judgment “may” not be enforceable in England.

PUBLICATION

Service by Publication is an alternative to personal service when a defendant's address is not known. Your court will require that you conduct a Due Diligence Search before issuing a court order allowing for service by publication. We handle the entire process, including the due diligence search affidavit, and preparing the Application and Order for Publication. We will provide all forms necessary for you to submit to your local court. Once the Order is signed by the judge, we will publish the entire file for one low rate of $995.00 and provide Proof of Publication.

LETTERS ROGATORY

As UK is a signatory to Hague Evidence Convention, Letters Rogatory are only required if documents originate from a country that is not a signatory to the said Convention. They are a request from a court in the originating country to a court in a foreign country requesting international judicial assistance related to service of process, deposition of witnesses or production of records.

Obtaining Evidence in Civil and Commercial Matters

The United Kingdom is a signatory to the Hague Convention on the Taking of Evidence Abroad in Civil and Commercial Matters. The designated Central Authority for the United Kingdom under the Hague Evidence Convention is responsible for receiving letters of request for the taking of evidence. Guidance on preparing such requests is available through the Hague Evidence Convention Model Letters of Request. Letters of Request must be prepared in duplicate.

Requests seeking the compulsory production or examination of evidence under the Hague Evidence Convention should be transmitted directly from the requesting court or authorized person in the United States to the U.K. Central Authority and do not require transmission through diplomatic channels.

Taking Voluntary Depositions of Willing Witnesses

Voluntary depositions of willing witnesses in civil and commercial matters are permitted in the United Kingdom regardless of the witness’s nationality. Depositions may be conducted orally or through written questions and may be taken by U.S. consular officers or private attorneys at the U.S. Embassy or another suitable location, such as a hotel or office, either upon notice or pursuant to a commission. Where the services of a U.S. consular officer are required to administer an oath or to provide interpreter or stenographer services, prior arrangements must be made directly with the U.S. Embassy.

SERVICE UNDER ARTICLE 5 OF HAGUE SERVICE CONVENTION

Many countries are signatories to The Hague Service Convention (treaty) that governs service of process to be effected between participating nations; United Kingdom is one of them. Service may be made through formal channel via the Central Authority which itself arranges for service by methods prescribed. The time frame for formal service can range from 3 to 6 months.

Advantage: Enforceable judgment.

Disadvantage: The time frame is generally longer than the informal method.

SERVICE UNDER ARTICLE 10 OF HAGUE SERVICE CONVENTION

As opposed to contrary belief, service under article 10 is permissible in UK if served under the instructions of a UK solicitor [Source 1] and SEC v. Bowerman, No. 24-CV-12282-AK, 2024 WL 4872335, at *2 (D. Mass. Nov. 22, 2024)]. Service is normally handled in a manner similar to methods used in the United States while ensuring the requirements of your Court are complied with and the Proof/Affidavit of Service is generated in the format required by your Court after incorporating the aforementioned requirements of Hague Service Convention. Currently, the time frame for the completion of service under article 10 is approximately 1 to 2 weeks (but can increase in case of service in remote locations).

Advantage: Enforceable judgment.

Disadvantage: Slightly more expensive although our prices are competitive
